Buying a property is one of the most significant investments one can make. However, the property purchasing process in Haryana requires one to pay certain charges. Stamp duty and property registration charges are mandatory charges that every property buyer in Haryana must be aware of.

Stamp duty in Haryana is a state-level tax levied on documents such as property transactions, lease agreements, mortgage deeds, etc. In Haryana, the rate of stamp duty varies depending on the document type and the property value involved.

According to recent news on stamp duty in Haryana, the charges remain unchanged as of April 2023, with the rates ranging from 6% to 8% in urban areas and 3% to 5% in rural areas. Also, the Stamp duty in Haryana for women continues to attract a 1% discount on the charges.

But there have been some updates in the payment process of stamp duty in Haryana. On April 12th, 2023, the government of Haryana, through the Urban Local Bodies (ULB), launched an online portal for payment and verification of stamp duty and registration charges. The goal is to promote digital transactions and reduce physical contact. These changes are expected to make payments more convenient and lower the risk of fraud.

How to Calculate Stamp Duty in Haryana

To calculate the stamp duty in Haryana, multiply the property value by the applicable stamp duty rate. For instance, the stamp duty rate for registering a property in urban areas of Haryana is 6% of the property's market value. Hence, if the property market value is Rs 50 lakh, the stamp duty payable will be Rs 3 lakh.

Please note: the stamp duty charges in Haryana are not the same everywhere. They are higher for urban areas and lower for rural areas. For instance, the stamp duty in Delhi is higher than in Tigaon. Also, to encourage women to buy property, the stamp duty in Haryana for female homebuyers is less than that for males.

Calculating the property registration charges in Haryana is not complicated. The registry rate in Haryana is 1% of the cost of the property. So if the property costs Rs 20,00,000, the registration fee is Rs 20,000.

The registration fees in Haryana vary depending on the value of the property. These charges are applicable on lease deeds, sale deeds, gift deeds, Loan Against Property deeds, partition deeds, etc.

There are two ways to pay for property registration charges in Haryana; online and offline.

Online procedure

  1. Visit the National Government Service Portal on their official website
  2. Select the e-stamping option
  3. Fill in the first party’s details, i.e., details of the person paying the stamp duty and the address of the property in the address column
  4. Write the name of the first and second party
  5. Select the category of stamp paper and amount from the amount list
  6. Review and finalise the payment

Offline procedure

Alternatively, you can purchase stamp papers worth Rs 10,000 and above from the treasury office.

Now deposit the amount under the head ‘0030 – Stamp and Registration’ in the state bank of India.

Documents Required for Property Registration in Haryana

To register a property in Haryana, you must present the following documents

  • The sale deed and related documents; contain details related to the property, such as its location, area, size, and boundaries. It also includes the terms and conditions of the sale. Other related documents include a possession letter, a no-dues certificate, and an encumbrance certificate.
  • Identity Proofs of Buyer and Seller; Aadhaar card, PAN card, passport, driving license, or voter ID card
  • Proof of payment of stamp duty and registration charges
  • Other relevant documents; proof of address of buyer and seller, No-Objection Certificate (NOC), ID proof of two witnesses, building plan, proof of ownership, property layout, digital photo, etc.

Process of Property Registration in Haryana

The property registration process in Haryana is simple and straight to the point.

  1. Visit the Jamabandi official website.
  2. Under the Property Registration Menu bar, you will see “Deed Templates.” Click on this option to download the templates.
  3. Once you download your preferred deed, fill in all the necessary information.
  4. Go to the sub-registrar's office at the appointed date and time. Submit your deed to the registration clerk, who will then give it to the sub-registrar.
  5. The sub-registrar will mark the deed.
  6. After that, the data is fetched, and then the deed is retrieved from the HARIS. The HARIS is a land record integrated system. It consists of all land records of all states of Haryana, including Bhulekh Faridabad and Bhulekh Gurgaon.
  7. In the HARIS registration process, the officer will update all the necessary information, including the buyer and seller details, e-stamp paper information, and transaction cost. After that, they capture a real-time photo.
  8. The sub-registrar will take the buyer and seller biometrics to regularise the deed. The land registry will then be printed on paper, and the print out sent to both parties. It will also be posted on Jamabandi official website by the Tehsil office.

Please note: the law requires that you complete this registration process within four months of purchasing your property.

The Sub-registrar of Assurances is responsible for registering the property and verifying the documents.
