People get Home Loans in India to buy a property or a ready to move in house. They use their purchased property as an investment and rent their house. Checking the tenants' background is called tenant verification which is necessary to do. It is done to check whether they have had prior police charges or any other red flags. This guide decodes everything you need to know about police verification for tenants, online police verification form, documents required for police verification, and so on.

Importance of Police Verification

All the city authorities in major districts have made police verification mandatory for tenants. A contravention of public order may lead to punishment under Section 188 of the IPC when the disobedience affects others.

Police verification is beneficial in the following ways.

  1. Thorough Background Check – Police verification helps in a thorough background check of tenants as it provides additional information from the criminal perspective.
  2. Forged Documents – These also help verify the prospective tenants' identity proofs.
  3. Illegal Activities – After the police verification, local police authorities have the information about the tenants in that area. This helps prevent tenants' illegal activities as they know that their data has been saved by law enforcement.

Background Check vs Tenant Police Verification

Background Check – The landlord does it to satisfy the tenant's genuineness and rent-paying capacity. It involves checking the personal and professional details of the prospective tenants.

Police Verification – This refers to additional verification where the police are involved. It allows them to verify the tenants' identities and check for any criminal record against them.

Tenant Police Verification Process

Police verification can both be online and offline. We have discussed both the processes in detail for a better understanding.

Offline Tenant Police Verification Process

  1. First, visit the nearest Police Station and fill out a tenant verification form. You can also download and submit the form to the police station.
  2. Affix a passport-size picture of the tenant.
  3. Provide proof of identity of the tenant, rent agreement, and proof of address.
  4. Sign the form and submit it to the sub-inspector.
  5. After submitting the form, remember to keep the acknowledgement receipt with you.

Online Tenant Police Verification Process

Most states have online portals for police verification. This removes the hassle of going to the police station and provides smooth police verification. All you need is some documents and the process can be completed in one go.

Prerequisites for Online Tenant Police Verification

  1. Rent Agreement – A legally binding Rent Agreement must be signed with the tenant, containing all tenancy terms and conditions.
  2. Proof of Ownership – Tenants must provide proof of ownership to prove that their landlord has the authority to rent out the property.
  3. NOC – A No-Objection Certificate is required from the society or the colony in case any rules or regulations are established concerning pets or other people coming over.
  4. Address Proof – Get the tenant's identity and address proof to verify the tenant's authenticity.

Steps to Follow for Tenant Police Verification Online Process

  1. Visit the state government’s police website where the property is situated.
  2. Find the online police verification form on the website. Either fill it online or download it.
  3. Enter the required details of the tenant and landlord, including the details related to name, address, and other essential details.
  4. Attach required documents such as a passport-size photo, identity proof, address proof, and other documents.
  5. Tick the checkbox that the information provided by you is accurate and correct to the best of your knowledge. It acts as a duly signed declaration.
  6. After providing the information and attaching the documents, ensure that the form is submitted and the acknowledgement receipt is saved and downloaded for future use.

Verification through Mobile Application

Mobile applications services are provided in various cities to further simplify and provide a hassle-free experience to the landlords. In Delhi, an application by the name of Suraksha has been brought into the public domain. The Police in Nashik have also launched an app that helps landlords find information about tenants without the need to go to the police station.

Consequences of Not Performing Tenant Police Verification

Many city authorities have made it mandatory to perform tenant police verification. Most states have also launched an online platform for performing tenant police verification online.

Further, the process is being simplified using mobile apps. If a landlord fails to complete tenant police verification, the landlord is liable for punishment when the tenant commits any crime.

In case of any disobedience or obstruction of justice created on the part of the tenant, the same could lead to the landlord being punished with imprisonment of 1 month or a fine of Rs 200 or both.

Suppose the tenant is involved in any activity that causes or has the potential to put human life in danger or endanger public security. In that case, the same could lead to the landlord being liable for imprisonment of up to 6 months or a fine of Rs 1000 or both. Therefore, it is mandatory to perform tenant police verification in addition to background checks of the tenants.
