All Platinum Debit Cardholders ("Cardholders") of Kotak Mahindra Bank Ltd. ("the Bank") availing the Visa PVR Offer (hereinafter referred to as the "Offer") promoted by VISA in association with PVR ("Merchants") shall be subject to the following Terms and Conditions:
Offer includes one free ticket out of every two tickets at a single purchase through www.pvrcinemas.com("Merchant Website")_using the Bank netc@rd.
This offer is valid upto September 30, 2010.
The Offer is not valid for PVR GOLD CLASS CINEMAS
A Maximum of 2 Free Tickets can be availed under the Offer for each calendar month.
The issuance of free tickets under the Offer is subject to its availability and is based on a first-come-first serve basis. The daily limit on available free tickets under the Offer is 150 per day on a weekday (i.e. Monday-Thursday) and on weekends (i.e. Friday to Sunday) the issuance of free tickets under the Offer is limited to 450 daily. The said daily limits on the available free tickets under the Offer are on aggregate basis across all the Merchant locations put together for each movie show per day.
Any addition to the Merchant outlets during the Offer Period, the Offer shall automatically extend to ticket purchases for such new Merchant Outlets.
The current purchase process at www.pvrcinemas.com will remain unchanged till the stage where the Eligible Visa Card number is provided. After this stage the website will recognize the eligible card, reduce the bill amount and inform the transacting Eligible Visa Card member accordingly.
Cardholders are not bound in any manner to participate in the Offer. Any participation by the Cardholder shall be voluntary and the Offer made by VISA and the Merchant are purely on a best effort basis.
Bank shall not be responsible for, nor does it guarantee or give warranty of the quality of goods and services provided by any of the outlets under the Offer, nor is the Bank liable for any deficiency in the products or inadequacies of the services so obtained or availed of by the Cardholder from the outlet.
The Bank shall not be responsible or liable in any manner whatsoever for any deficiency or inadequacy in the services rendered by the Merchant(s), its agents or representatives or for any loss whatsoever of any nature and the Cardholder hereby agrees not to hold the Bank responsible or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses that the Cardholder may suffer on account of the Offer.
The Offer cannot be claimed for purchases made through gift vouchers, point certificates, any other points redemption schemes, credit notes, any other gift vouchers and discount vouchers. No other voucher, certificate, credit note or point redemption scheme can be clubbed with the Offer.
The benefits offered under the Offer are non-transferable and cannot be exchanged for cash or any other merchandise.
Any dispute in this regard should be directly addressed to the Merchant(s) and the Bank shall not be made a party in any dispute regarding the Offer.
The Bank shall not be responsible for any liability whatsoever to any person in regard to this Offer.
The Offer is subject to force Majeure events.
The Bank reserves the right to add/alter/change or vary any or all of these terms and conditions or to replace, wholly or in part, at any time without notice.
Any dispute relating to the offer or the terms and conditions shall be subject to the jurisdiction of the Courts in New Delhi only. The disputes if any shall be governed under the provisions of Arbitration and Conciliation Act, 1996 (as amended up to date)
Any participation by the Cardholders in the Offer is deemed as acceptance of terms and conditions herein in addition to those of VISA and that of the respective Merchant/s.
These terms and conditions shall be read in conjunction with the Bank’s General Terms and Conditions.
All Cardholders availing the Offer and purchasing the products offered or availing the services under the Offer shall be deemed to have read, understood and accepted these terms and conditions.
