The Visa Debit Cashback Promotion ("Promotion") promoted by VISA is open to all debit cardholders and the netc@rd users (collectively termed as the "Cardholders") of Kotak Mahindra Bank Ltd. ("the Bank") subject to the following Terms and Conditions:

• The Promotion shall be valid during the period 1 July 2010 to 30 September, 2010 (both inclusive) (the "Promotion Period").
• Visa under the Promotion shall identify 62,000 unique qualifying VISA debit cards issued by various Visa member banks in India including the debit card and netc@rd issued by Kotak Mahindra Bank ("Eligible Card Numbers") at the end of the Promotion Period, the eligibility criterion being:
  a.The Bank debit card and or Bank netc@rd ("Card") has been used to complete at least 12 or more successful transactions OR should have a cumulative purchase amount of Rs 20,000 or above, as the case may be, in the Promotion Period;
  a.cash withdrawal transactions at ATMs and cash withdrawal transactions at point-of-sale will not be counted towards qualification.
• Visa will identify and sort the first 62,000 Eligible Card Numbers based on the following criteria: firstly, the higher of the number of transactions during the Promotion Period; secondly, the higher of the cumulative purchase amount during the Promotion Period, and; lastly, the earlier of the first transaction date and time, in that order of precedence.
• The first 2,000 unique Eligible Card Numbers will be eligible to receive INR 2,000 (Indian Rupees Two thousand) or 10% (ten percent) of the cumulative purchase amount done on such cards in the Promotion Period, whichever is lower, as a cashback credits with the narration "Visa Debit CB Promotion" via VISA Money Transfer. The next 60,000 Eligible Card Numbers will be eligible to receive INR 100 (Indian Rupees Hundred) as cashback.
• The Bank shall process the cashback credits with the narration "Visa Debit CB Promotion", to the selected Cardholder's Bank account linked to the Card.
• The processing of the cashback credit shall be subject to Force Majeure events and the Bank and Visa shall not be responsible for any delay in posting of the said credits into the selected Cardholders' account.
• Visa will not entertain any request to provide cashback via any means other than through Visa Money Transfer.
• All selections and/or decisions made by Visa in all aspects in relation to the Promotion are and will be final and conclusive. No enquiries or complaints will be accepted or entertained in this regard by the Bank and Visa.
• The Promotion is purely promotional in nature and Visa may, at its sole discretion, discontinue the Promotion at any time, whether prior to or during the Promotion Period, without prior notice. Visa will not, in any event, be liable for, responsible for or required to make any selection of Eligible Card Numbers. Visa is and will not be obliged to publish the details of selected Cards or the selection process.
• Visa reserves the absolute right to, at its sole discretion, amend, vary and/or withdraw any of the terms and conditions of the Promotion without prior notice.
• Nothing contained herein will, or be construed to, constitute a contract under the laws of India (including without limitation the Indian Contract Act, 1872, in force) between Visa, Cardholders and/or the Bank.
• The Promotion and these terms and conditions will be governed by the laws of India.
• Information about the Promotion is correct at the time of publication.
• The Bank shall not be responsible or liable in any manner whatsoever for any deficiency or inadequacy in the services rendered by VISA under the Promotion.
• The Bank shall not be made a party in any dispute regarding the Promotion.
• The Bank is acting only in the capacity of an issuing bank of VISA debit cards and shall not be responsible for any liability whatsoever to any person in regard to this Promotion.
• Regular debit card/ netc@rd terms and conditions shall apply, as the case may be.

• All Cardholders availing the Promotion shall be deemed to have read, understood and accepted these terms and conditions in addition to those of VISA.
